Terms of Service
Welcome to Onlymails! These terms and conditions outline the rules for using our website and services.
1. Introduction and acceptance
These Terms of Service ("Terms") form a binding agreement between you and SuperGrowth ("Onlymails", "we", "us", or "our"), the operator of Onlymails and of the websites available at onlymails.co and app.onlymails.co (together, the "Service"). By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. What Onlymails is
Onlymails is a curated library of marketing emails. We collect, organize, and present marketing emails sent by brands so that marketers, designers, founders, and other professionals can research campaigns, study trends, and find inspiration for their own work. The Service may include features such as searching and filtering the library, following brands, saving emails, and organizing them into folders. Some features and content are available to every registered user; others require a paid subscription (see Section 8).
3. Eligibility
You must be at least 16 years old, or the age of digital consent in your country, to use the Service. By using the Service you represent that you have the legal capacity to enter into these Terms.
4. Your account
To access most features you must create an account using an email address and password, or through Google Sign-In. You agree to provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at support@onlymails.co if you suspect unauthorized use. Accounts are personal to you; you may not share, sell, or transfer your account, and accounts created by automated means are not permitted.
5. Third-party brand content and intellectual property
The marketing emails shown in the library were created and sent by third-party brands. Onlymails does not own, and does not claim to own, that content. All intellectual property in each email, including its copy, design, images, logos, and trademarks, remains the property of the brand that created it or its respective rights holders. These emails are presented for the purposes of research, commentary, education, and inspiration, as a record of publicly distributed marketing communications.
We do own the Service itself. This includes our software and source code, the design and interface of our websites, our name and logo, and the way we collect, clean, classify, organize, and present the library, including our categories, metadata, and any analysis or descriptions we generate. Nothing in these Terms transfers any of those rights to you.
6. Copyright and removal requests
We respect the rights of content owners. If you are a brand or rights holder and would like an email or other material removed from the library, contact us at support@onlymails.co with enough detail to identify the material and your relationship to it. We review good-faith requests and remove or restrict the relevant material promptly where appropriate.
7. Acceptable use
Onlymails is a research and inspiration tool. You may study, reference, and take inspiration from the emails in the library for your own work. You may not:
• copy, scrape, crawl, harvest, or otherwise extract the library or any substantial part of it by automated or systematic means;
• resell, redistribute, sublicense, or otherwise make the content or your access available to anyone outside your account;
• reproduce an email's content, layout, or assets wholesale into your own commercial communications (taking inspiration is fine, wholesale copying is not, and is also likely to infringe the original brand's rights);
• circumvent, disable, or interfere with any limits, quotas, security, or access controls of the Service;
• upload or transmit malware, or attempt to gain unauthorized access to the Service, its servers, or other users' accounts;
• impersonate Onlymails or any other person, or use the Service in any way that is unlawful, harmful, or that disrupts or overburdens the Service for others.
8. Subscriptions, billing, and refunds
Onlymails offers a free plan and one or more paid plans. Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. By subscribing, you authorize us to charge the applicable fees, including automatic renewal at the end of each billing period, until you cancel.
You can cancel at any time from your account settings or by contacting us; cancellation takes effect at the end of the current billing period, and you keep access to paid features until then. Except where required by law, fees already paid are non-refundable, and we do not provide refunds or credits for partial billing periods, downgrades, or unused time.
We may change our prices or plan features. For existing paid subscribers, we will give at least 30 days' notice before a price change takes effect, and the new price will apply from the next renewal.
If you are a consumer in the European Union, you may have a statutory right to withdraw within 14 days of purchase. Because the Service gives you immediate access to digital content, you agree that we may begin providing it right away, and you acknowledge that your right of withdrawal is lost once the Service has been fully performed.
9. Availability and changes to the Service
We work to keep the Service available and useful, but we provide it on an "as is" and "as available" basis. We may add, change, suspend, or remove features at any time, and the contents of the library may change as emails are added or removed.
10. Disclaimers
To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that any classification, description, or analysis we provide is accurate or complete, or that the third-party content in the library is accurate, current, or suitable for any particular use. Any reliance you place on the Service is at your own risk.
11. Limitation of liability
To the fullest extent permitted by law, Onlymails will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or one hundred euros (EUR 100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Onlymails and its operator from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third party's rights.
13. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) continue to apply.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to let you know, for example by email or through the Service, before they take effect. Your continued use of the Service after the changes become effective means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of France, without regard to conflict-of-law rules, and the courts of France have jurisdiction over any dispute. If you are a consumer, you keep the benefit of any mandatory protections of the law of your country of residence, and you may also use the European Commission's online dispute resolution platform.
